7. foodpanda shall not be responsible and liable for the promotion or any component thereof including

4. The Promotion is available to foodpanda‘s customers. The customers must enter the eligible

5. The Promotion is applicable to select accommodations marked “Promo Eligible” in designated
destinations made through a dedicated Site at: www.agoda.com/foodpanda
6. The Promotion is applicable to accommodation room charges only (excluding taxes, service fees,
processing fees, personal expenses and similar charges).
7. The Promotion discount will only be displayed on the booking form of the Site after entering the
eligible promocode.
8. The Promotion is subject to these General Terms and Conditions, which are subject to change at any
time. In the event of any ambiguity, these General Terms and Conditions shall be construed in accordance
with Agoda’s interpretation.
9. Agoda does not guarantee uninterrupted services of the Site.
10. All bookings made through the Site are at all times subject to Agoda’s Terms of Use at www.agoda.com and other policies then in effect.
11. Notwithstanding anything to the contrary, to the maximum extent permitted by law, Agoda will not
be liable to you in connection with the Promotion, the Privilege, these General Terms and Conditions or
any other related subject matter.
12. foodpanda shall not be responsible and liable for the Promotion and the Privilege or any component
thereof including but not limited to, any limitations that may prevent you from redeeming and/or using the
Promotion and the Privilege.
13. foodpanda shall also not be liable for any claims by you or be accountable for third-party claims
or losses of any nature, including but not limited to, loss of profits, punitive, indirect, special,
incidental, or consequential damages or for other damages and any related claims of any nature, including
direct, indirect, third party, consequential or other damages resulting arising out of or in connection
with your participation in the Promotion and use of Agoda’s services or any component thereof.
14. foodpanda does not take any responsibility in the case of any event that may prevent you from
participating in the Promotion of any component thereof, as a result of certain technical restrictions or
other limitations or force majeure, which include but is not limited to regulatory events, government
directive, government intervention, pandemic, movement control orders, and act of God, etc. Agoda’s rights
in relation to these General Terms and Conditions, the Terms of Use and other stated policies are
complementary to the maximum extent possible, and nothing herein shall be construed so as to limit,
restrict, or otherwise adversely affect any other rights of Agoda.
15. If any part of these General Terms and Conditions is found to be invalid, the remainder shall
continue to be valid and to the limited extent necessary will be replaced with such new terms having
similar effect.
